We’ve come a long way from the free-for-all of Napster and Kazaa. But even with the millions of sales on iTunes and other legit services, file-sharing still outstrips CDs and authorized downloads combined. Having failed at outright war - and dealing with a crippled business model - the industry’s hope may lie in exercising “soft power,” entering into collective licensing agreements with ISP providers that would allow music downloading based on a monthly fee a la cable TV. It’s a route favoured by “public domain” activists and progressive industry thinkers alike. In this session, we crunch some numbers and figure out the relative benefit for artists, songwriters and labels.

Music creators and rights holders have waited for over 10 years for a solution to the quandary of how to address unauthorized music file sharing on peer-to-peer, wired and wireless networks. The issue of “Internet Governance” has become a hot topic around the world that generates a wide array of views and myriad proposals for business and legislative solutions. Each year the IAEL publishes a book on a topic of international concern in the entertainment business. The 2010 book is about collective licensing at the ISP level. This idea continues to gain momentum each year as revenues continue to decline in the media distribution businesses as a result of the transition from physical to digital distribution. At CMW we believe the industry needs a legislative framework that gives the consumer safe, easy access to music in the formats and delivery systems they prefer, while ensuring that music creators and rights holders are fairly compensated.
